Terms of Use

1. Acceptance

These Terms of Use ("Terms") govern your use of the Fluid Art application for iOS and Android (the "App"), published by Presenza ("we", "us"). By downloading or using the App you agree to these Terms. If you do not agree, do not use the App.

2. License

We grant you a personal, non-exclusive, non-transferable, revocable license to install and use the App on devices you own or control, for your personal, non-commercial enjoyment, in accordance with these Terms and the rules of the app store you obtained it from (Apple App Store or Google Play).

3. Acceptable use

You agree not to:

• reverse engineer, decompile or disassemble the App except where permitted by law;
• redistribute, sell, rent or sublicense the App;
• use the App in any way that violates applicable laws.

4. Open-source components

The App contains open-source software. The fluid simulation is a port of WebGL-Fluid-Simulation (MIT License, © 2017 Pavel Dobryakov), and the App uses the raylib library (zlib/libpng License). These components remain subject to their own license terms.

5. Photosensitivity warning

The App displays moving, glowing, colourful imagery. A very small percentage of people may experience discomfort or seizures when exposed to certain light patterns. If you or anyone in your family has an epileptic condition, consult a physician before using the App, and stop using it immediately if you experience dizziness, altered vision or involuntary movements.

6. Disclaimer of warranties

The App is provided "as is" and "as available", without warranties of any kind, express or implied, including fitness for a particular purpose, merchantability or non-infringement. We do not warrant that the App will be uninterrupted or error-free on every device.

7. Limitation of liability

To the maximum extent permitted by applicable law, Presenza shall not be liable for any indirect, incidental, special or consequential damages arising out of or related to your use of the App. Nothing in these Terms limits liability that cannot be limited under applicable law, and nothing affects your statutory rights as a consumer.

8. Changes to the App and these Terms

We may update the App and these Terms from time to time. Material changes will be reflected on this page with an updated "last updated" date. Continuing to use the App after a change means you accept the updated Terms.

9. Termination

This license ends automatically if you breach these Terms. You may end it at any time by deleting the App.
